Subject: Application Forms Required for Requesting Authorization to Conduct Marine Scientific Research in the Republic of Maldives, October 5,1994.

Enclosed please find a copy of the form required by the Republic of Maldives for requesting authorization to conduct marine scientific research within their jurisdiction, as well as a list of regulations and instructions for application. The form requests information generally in compliance with the UN Convention on Law of the Sea. This document is required in addition to materials required by NTRVO No. 67.

Since there is no stated prior notice requirement for research vessel clearance requests for the Maldives, it is required that all requests be submitted to the Department of State at least three months prior to the start of proposed research, and in compliance with the "UNOLS Handbook for International Operations of U.S. Scientific Research Vessels".

APPLICATION FOR PERMISSION FOR MARINE SCIENTIFIC RESEARCH IN THE MARITIME ZONES OF THE REPUBLIC OF MALDIVES

1. Name of the sponsoring organisation/individual(s).
2. The name of the director and research staff of the project with their Bio Data.
3. Nationality.
4. Whether the organisation is a Government agency or a private institution.
5. The nature, objectives and description of the research project with complete schedules of activities.
6. The complete schedule of activities, including the expected date of commencement and termination of the research project, the dates of laying and recovery of observation buoys and their positions, arrivals and departure or removal of personnel, installations, vessels and other equipment and vessel to be used.

The following additional information to be provided in the case of ship-based marine research.

1. The precise geographical areas in which the activities are to be conducted, including routes and ports to be used during such research.

2. The proposed ship's track showing the sequence of each leg to be traversed is to be indicated from the time ship leaves the last foreign port until it arrives at the next foreign port.

3. Particulars of the vessel to be used.

(a) Bathymetric, echo sounder, precision, depth recorder etc.
(b) Magnetic
(c) Geological
(d) Gravity
(e) Biological
(f) Chemical
(g) Seismic
(h) Meteorological
(i) Physical (Temperature, Current, Conductivites etc)
(j) Navigational Radar, (Loran, Omega, Inertial, Satellite Receivers etc)
(k) Radars other than navigational radars fitted, purpose, function made, model and frequency band.
(l) Electronic devices eg. instantaneous frequency measurement and analyser equipment fitted on board, purpose, frequency, coverage etc.
(m) Radio transmitter/receivers and D/F - number power output and frequency covered.
(n) Data Logging and processing equipment type and details of computers and interfaces.
(o) Oceanographic and Hydrographic winches.
(p) Sonar and TV equipment, acquostic monitoring and frequency analysers fitted on board, purpose, frequency and brief description.
(q) Any other items of under water research such as STD probes, submercibiles etc.
(r) Number of Maldivian Officers and research scientists/hydrographers that can be embarked on board the ship for the duration of research/stay in the Exclusive Economic Zone of Maldives, for participation in the research project, including, access to all research records sample etc. There shall be no charge for messing and accommodation.

Notes: Wherever the space provided is not adequate, please supply the required information fully in a separate sheet, giving reference to the number in the Application form and attach same to the form.

REPUBLIC OF MALDIVES.

REGULATIONS FOR MARINE SCIENTIFIC RESEARCH IN THE MARITIME ZONES OF THE REPUBLIC OF MALDIVES

1. The Organisation/individual(s) carrying out the research should undertake:

(a) to provide the Government of Maldives with copies of raw and processed data, representative samples and interpretations at the end of each phase of the programme and final results at the conclusion of the research project;

(b) to ensure that the research results and conclusions of the project of direct significance for the exploration and exploitation of the resources in the area shall not be published or divulged to a third party without prior express consent of the government of Maldives;

(c) to provide the Government of Maldives with quarterly reports on the progress of the project;

(d) not to make any changes in the project or allow participation in the research activities by any third party without the prior express consent of the Government of Maldives;

(e) to allow inspection of the vessel(s)/equipment by the Maldivian Authorities prior to the commencement of the project and any time thereafter during the research period;

(f) to provide the exact track traversed by the ship during its survey;

(g) to comply with all Maldivian laws and regulations relevant to activities in the Exclusive Economic Zone/the Territorial Waters of the Maldives;

(h) to switch off all systems on board the vessel(s) doing survey work if so directed by the Maldivian Official on board;

(i) to ensure that the marine scientific activities will be carried out without causing interference, directly or indirectly, with the activities of the Maldives in the exercise of its sovereign rights, other rights and jurisdiction according to Maldivian laws and in accordance with the U.N. Convention on the Law of the Sea;

(j) to ensure that marine scientific research will be conducted with due respect to the safety of navigation and human life on sea as well as protection of the marine environment, including marine resources, both living and non-living;

(k) to ensure that the marine scientific research activities do not cause any damage to equipment/structure/installations located in the research area;

(l) to ensure that research activities do not interfere with legitimate fisheries activities in the Maldivian Exclusive Economic Zone;

(m) to remove, if not otherwise agreed, on completion of the research, the anchorage and/or scientific equipment from the research area;

(n) to confirm that the proposed research shall not form the legal basis for any claim to any parts of the sea or its resources in the Exclusive Economic Zone of the Maldives; and

(o) to hand over any arms and ammunition on board the vessel to the Maldivian Government authorities at the time of arrival in the first port in the Maldives. Arms and ammunition so handed over will be returned to the vessel at the time of departure from the Maldives.

2. The Government of the Maldives reserves the rights to require the suspension/cessation/termination of any marine scientific research activities in accordance with Article 253 of the U.N. Convention on the Law of the Sea, 1982.

3. The following minimum data and information should be provided at the time of application for permission to undertake marine scientific research in the Exclusive Economic Zone/the Territorial waters of the Maldives.

Note: No. 1 (e), (f), (h), (o), No. 2 and No. 3 (f), (g), (i) & (j) 18 of this Regulation apply only to ship-based research.
